It is expected that all contracting parties with BFD will comply with the following code of conduct:
It is responsible for encouraging, advocating, and promoting the dissemination and advocacy of these ethical standards. The contracting party should familiarize the sub-contractors with the principles of the code of conduct and encourage them to adhere to these standards. The Code of Conduct applies to all contracting parties with BFD and all who need to sign it, and thus they affirm their adherence to the standards to the extent that can be applied to their situation.
1. Respect Human Rights:
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not violated the basic human rights according to the European Agreement of Human Rights1950.Respecting the dignity and value of humanity to all people, including the respect of the equality of right of men and women.
2. The Illegal Activities:
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not involve in any kind of illegal activities.
3. Corruption and Fraud Prevention:
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not involve in any kind of corruption that are identified by the Transparency International, which considered as a miss use of authority to fulfil personal profit, such as bribery, blackmailing, fraud, Money laundering, financial facilities, embezzlement, extortion and obstruction of justice.
4. Terrorism
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not conduct any contracts or transactions with or providing resources and support for individuals or terrorism.
Also, not to receive or participate in any kind of training in any act or crime described in Article 2 (5, 4, 3, 1) of the International Agreement for the Suppression of the financing of terrorism, adopted by the United Nations General Assembly in resolution 54/109 of December 9, 1999.
5. Environment:
·The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not to violate any international environmental agreements
In addition, the contracting party undertakes to promote a precautionary approach to environmental challenges and not to damage, destroy or cause any harm to the environment in any way. Moreover, the contracting party undertakes to encourage the development and diffusion of environmentally friendly technology, and to implement initiatives to enhance sustainability and environmental responsibility.
6. Mines and Weapons:
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not participate in any activity of patents, development, assembly, production, trade or manufacture of mines, or to engage in such activities related to components mainly used in the manufacture of mines. The term “mines” means those packages defined in Article 2, 4, 1, 5) of the Second Protocol to the Agreement on the Prohibition and Restriction of the Use of Certain Types of Conventional Weapons Which may be considered to have excessive damage or indiscriminate effects2/20/1980.
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not in any activity of patents, development, assembly, production, trade or manufacture of weapons, such as Firearms, chemical and biological weapons and nuclear weapons.
7. Sexual Exploitation and Abuse:
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall protect all people from sexual exploitation and abuse. That means any actual exploitation or attempting to exploit the state of vulnerability, differential powers, or trust for sexual purposes, but this is not limited to monetary to achieve cash, social or political profits through the sexual exploitation of others. Likewise, the term "sexual assault" means any actual physical or sexual assault, whether by force or coercion or under the unequal relationship.
8. Child Labor:
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not participate in any practices that do not meet with the agreed rights in children’s rights agreements. Those are including protecting children from doing any potential risky work, represents an obstacle to children education, or might causing a health or mental or physical development, social, spiritual, or moral damage.
9. Unfree Labor:
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not use any form of unfree and mandatory labor (forced labor).
10.Work Conditions:
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not to allow work conditions that violate the 1981 Occupational Safety and Health Agreement, including the 2002 Protocol, the International Labor Organization's 1970 Minimum Wage Agreements, as well as the Working Hours Agreement.
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall protect workers from acts of physical, verbal or psychological harassment and abuse, or the threat of using it in the workplace, whether by their colleagues or their managers.
11.Discrimination in Workplace:
·The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not to discriminate any of his workers based on race, color, gender, language, political opinion, religion group, social or national origin, property, birth, trade union affiliation, sexual orientation, health status, age, disability, or any other distinctive features.
The contracted party acknowledges and undertakes that s/he and all her/his sub-contractors shall not to take any resolutions regarding the employment, starting from the contracting to end of service and retirement, which are not based only on objective and relevant criteria.
12.Transparency and Accountability:
·The contracted party undertakes to fully revealing any relevant materials or documents at any time, that BFD can study any allegation of violating the code of conduct.
Any breach of the acknowledgments and undertakings of this "code of conduct" gives the foundation the right to end any contractual relations with the contracting party as soon as s/he is notified, without bearing any financial cost to BFD.
